6. Placing an Order
A. Order Acceptance and Billing
You represent and warrant that you have the right to use any credit card or other means of payment that you provide to us. By providing payment card information to us, you authorize us to store and use the card as a payment method for purchases made through your OnceUponAPromo.com account, including on Once Upon A Promo affiliated sites and properties which you access via your OnceUponAPromo.com account credentials.
All billing information you provide to us must be truthful and accurate. Providing any untruthful or inaccurate information is a breach of these Terms of Use and may result in cancellation of your order. Prior to accepting an order, we may also request additional information from you. Verification of information may be required prior to the acknowledgment or completion of any purchase.
We reserve the right to limit the quantity of items purchased per person, per store, or per order for any reason. We also reserve the right to refuse or cancel an order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified by our credit and fraud avoidance associate. We will attempt to contact you if all or any portion of your order is canceled or if additional information is required to accept your order.
B. Chargebacks, Fraud Prevention, and Void Transactions.
For your protection, Once Upon A Promo may use various fraud prevention protocols and policies, and industry-standard verification systems, to reduce fraud and minimize chargeback risks. You must comply with such protocols and policies, including card authentication, and “ship to” and “bill to” address verification. Once an order is placed, you may not change any authenticated payment information or any verified “ship to”/“bill to” address. If there is a systemic error which results in the processing or acceptance of a transaction for which authorization has been declined, that transaction will be void.
C. Payment and Shipping
“Products” means those goods offered for sale via the Site. By confirming your purchase at the end of the checkout process, you agree to accept and pay for the Products, as well as all shipping and handling charges and applicable taxes and fees. State and local taxes may apply to your purchase. Since we do not have a tax presence in your state, you may be responsible for reporting and paying these taxes directly to your local tax authority.
Any additional fees related to the delivery of your Order can be found on your Order information page. You may select your preferred payment method from a list of options available at the time of checkout. You will be charged in full at the time your order is placed.
Orders will be shipped to the address you designate, provided the address is complete. Certain addresses will be ineligible for shipment, such as PO box addresses. Items in your order may be shipped via a single shipment, or via multiple shipments. Once your order is delivered to the carrier, ownership in the items and risk of loss will shift from Once Upon A Promo, to you.
When available, delivery times depend on the shipping method and the destination of the order. These estimates are provided at checkout and are not guaranteed. Delivery times may be affected by carrier capacity, weather, Product(s) in an order, or other factors beyond Once Upon A Promo’s control. Once Upon A Promo is not liable for orders that are not deliverable due to inaccuracies in the delivery address or delivery location being inaccessible.
D. Electronic Communications.
When you place an order through the Site, you are communicating with Once Upon A Promo electronically, and you consent to entering into this agreement by electronic means, and to receive communications from Once Upon A Promo electronically/via email. Please note that e-mail communications will not necessarily be secure; accordingly, you should not include credit card information or other sensitive information in your e-mail correspondence with us.
7. Returns and Refunds
Once Upon A Promo reserves the right to deny returns, refunds, and exchanges, including but not limited to cases of fraud, suspected fraud, or abuse.
We want you to be happy with your purchase. If you’re not satisfied with the quality of any product, you can return it within 14 days for an exchange or refund. Your item must be returned in sellable condition, with original packaging. Please review our return and refund policy here for additional details. Refunds are always issued to the original payment method whenever possible.
8. SMS/MMS Mobile Message Terms & Conditions
Once Upon A Promo (hereinafter, “We,” “Us,” “Our”) is offering a mobile messaging program (the “Program”), which you agree to use and participate in subject to these Mobile Messaging Terms & Conditions and Privacy Policy (the “Agreement”). By opting in to or participating in any of our Programs, you accept and agree to these Terms & Conditions, including, without limitation, your agreement to resolve any disputes with us through binding, individual-only arbitration, as detailed in the “Dispute Resolution” section below. This Agreement is limited to the Program and is not intended to modify other Terms & Conditions or Privacy Policy that may govern the relationship between you and Us in other contexts.
A. User Opt In: By opting in, you consent to receive SMS/MMS messages from Once Upon A Promo. Regardless of the opt-in method you utilized, you agree that this Agreement applies to your participation. By participating, you consent to receive business-related text responses, updates, and multimedia images from Once Upon A Promo, at the phone number associated with your opt-in, and you understand that consent is not required to make any purchase from Us. Message and data rates may apply. You can reply STOP at anytime to opt out of future text communications.
B. User Opt Out: If you do not wish to continue receiving text messages or no longer agree to this Agreement, you agree to reply STOP to any mobile message from Us in order to opt out. You may receive an additional mobile message confirming your decision to opt out. You understand and agree that the foregoing options are the only reasonable methods of opting out. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.
C. Our Disclaimer of Warranty: The Program is offered on an “as-is” basis and may not be available in all areas at all times and may not continue to work in the event of product, software, coverage or other changes made by your wireless carrier. We will not be liable for any delays or failures in the receipt of any mobile messages connected with this Program. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator and is outside of Our control. Carriers are not liable for delayed or undelivered mobile messages.
D. Participant Requirements: You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.
